LATE NOTICE

Stone & Johnson attorneys have successfully obtained summary judgment for insurers, based on the notice condition found in most comprehensive general liability policies. Some of these rulings have included:

• Industrial Coatings Group Inc. v. American Motorists Ins. Co., 658 N.E.2d 1338 (1st Dist. 1995) (fourteen month delay in giving notice after receipt of PRP letter was late as a matter of law and relieved insurer of duty to defend)

• First State Ins. Co. v. Montgomery Ward & Co., 267 Ill.App.3d 851, 642 N.E.2d 715 (1st Dist. 1994) (four year delay after filing underlying complaint was late as a matter of law and relieved excess liability insurer of duty to indemnify)
